The Washington Post reported that the Social Security Administration purposely and falsely labeled about 6,100 living immigrants as dead by adding them to its Death Master File, under a strategy pushed by Musk's U.S. DOGE Service and the Department of Homeland Security to cut them off from legally earning wages and push them to leave the country. A senior executive who objected to the plan, and had clashed with the chief information officer installed by Musk, was escorted out of the building and placed on leave.

Days later, according to people with knowledge of the matter cited by the Boston Globe, he gave the maximum allowed donation to Gill and six other Republican members of Congress who had endorsed judicial impeachments or called for "action" in response to rulings against the Trump administration. Chief Justice John Roberts said impeachment "is not an appropriate response to disagreement concerning a judicial decision".

ADL CEO Jonathan Greenblatt, whose organisation had initially defended the gesture, replied that it is "inappropriate and offensive" to make light of the Holocaust, and the ADL said such jokes "trivialize the Holocaust".

Response: Musk did not explicitly address the gesture's intent; he wrote on X "Frankly, they need better dirty tricks. The 'everyone is Hitler' attack is sooo tired." He replied "Thanks guys" to the ADL, which had written "It seems that Elon Musk made an awkward gesture in a moment of enthusiasm, not a Nazi salute".

In May 2026 the Alameda County Superior Court denied Tesla's latest attempt to have the case thrown out, and a bench trial before Judge Peter Borkon opened in Oakland on 21 September 2026.

The judge later cut the award to $15 million; Diaz chose a retrial, which ended in a $3.2 million verdict in April 2023, and the parties settled in March 2024.
